1. General

• • In these Terms and Conditions, the following definitions shall apply:
    • “Customer” means any person who accesses and uses the E-shop and places an order with us including you.
    • “Disclaimer Statement” means the disclaimer applicable to the E-shop and all matters and services related thereto, a copy of which is accessible via here.
    • “Product(s)” means any and all products offered for sale on the E-shop.
    • “Privacy Policy” means Gleneagles Pharmacy’s policy and practices regarding the collection, use, retention, transfer and access of personal data collected in connection with the E-Shop, a copy of which is accessible via here.
    • “Terms and Conditions” means these terms and conditions, the Disclaimer Statement and the Privacy Policy.
  • These Terms and Conditions incorporate the Disclaimer Statement and the Privacy Policy.

  • We shall endeavour to ensure that prices, details and sizes of Products at our E-shop are up-to-date. Prices are subject to change without prior notice and all orders are subject to our acceptance at our sole discretion and stock availability.

  • We shall endeavour to ensure Product(s) displayed at our E-shop are in stock. If from time to time any Products become out of stock, we reserve the right to offer alternative product(s) of similar value and style.
  • All orders are subject to confirmation of final availability and we reserve the right to reject the order in the event that any of the products or services requested are unavailable for any reason whatsoever.
  • Prices listed on the E-shop are for online purchase only.  Prices for some Products may differ from those charged for the same Products at any physical stores, pharmacies or dispensaries in Hong Kong operated by us or our affiliates under the “Gleneagles” brand.
  • We are serving and delivering our products only to end consumers and not for re-sale purposes. If we have grounds to believe that you are not purchasing our products as an end user, we reserve the right to decline or cancel your order.
  • We may from time to time and at our absolute discretion set credit limits or transaction limits for any Customer and/or limits sales to any Customer.

2. Registration

• You are required to register as a user before placing any order through our E-shop. During the registration:
  • You must provide us with accurate, complete and up to date registration information;
  • You must safeguard the privacy of your username and password;
  • You authorise us to assume that any person using the E-shop with your username and password is either you or is authorized to act for you;
  • We have the absolute discretion to refuse registration of a potential customer and to terminate the registration of any customer for any reason whatsoever.
• Please inform us via our website/by email to dispensary@gleneagles.hk or by phone at 3153 9750 immediately of any change to the information that you provided so that we can communicate with you effectively.

3. Privacy protection

We are committed to safeguarding the privacy of individuals with respect to personal data. We therefore make sure that our policies and practices in relation to the collection, use, retention, transfer and access of personal data comply with the requirements of the Personal Data (Privacy) Ordinance (Chapter 486) under the laws of Hong Kong and other relevant local laws available. Please refer to our Privacy Policy.

4. Payment

• Our E-shop accepts payment by designated credit cards, debit cards or other designated electronic means as specified by us. The payment methods we accept are listed on our website and shall be updated from time to time.
• The applicable price shall be the price listed in our E-shop as at the time of the actual transaction.
• Where there are additional charges for delivery, such charges will be set out separately for your acknowledgement and confirmation prior to proceeding to payment.
• To provide secure online transactions, we employ Internet’s Transport Layer Security (TLS) technology. It encrypts your personal information, including credit card number, name and address, so to ensure protection through the Internet.

5. Delivery service (applicable if you have selected to have your order(s) delivered to a designated address)

• Free delivery service will be provided for each order with net spending of HK$500 or above.
• Delivery service is not available at any non-permanent address, warehouses, outlying islands and Discovery Bay, and non-service areas as listed in Appendix A. We reserve the right to change the non-service areas from time to time by posting an updated version on our E-shop website, without any prior notice to you.
• Delivery is available Monday to Friday (2:00pm to 6:00pm).  Delivery service will not be provided on Saturdays, Sundays and public holidays.
• All expected delivery dates and time are estimates only. We shall not be liable for any loss or damage incurred or suffered by you as a result of any late delivery.
• We reserve the right to charge an additional fee in respect of any request for change in delivery time, date and/or place, delivery of additional purchase, or change of purchased item.
• The delivery times may be affected by inclement weather conditions, including but not limited to rainstorms/typhoons/severe weather warnings. In the case of Typhoon Signal No.8 or above, “extreme condition”, and/or the Black Rainstorm Warning are in effect, the delivery will be postponed until the signals or lowered/removed. We appreciate your understanding and patience during these circumstances, as the safety of our delivery personnel and the integrity of your order are our top priorities.
• If for security reason or any other reasons whatsoever, our courier is not able to deliver the goods to the designated address as specified in your order and get your receipt confirmation, the goods will be returned to our office. We reserve the right to request for you to collect the goods from our office and will not arrange any delivery and this shall not constitute a breach to our obligations herein. If re-delivery is requested, the customer will be charged a delivery fee.
• In case of any dispute, our determination shall be final.

6. Self pick-up

• Customers may opt to pick up their orders directly from our designated location.
• Upon placing an order, you will receive a notification when your items are ready for pickup. Please ensure you are able to clearly show the order confirmation email for pick up.
• Orders must be collected within [e.g., 7 days] of notification. If not collected within this period, the order may be subject to cancellation and/or restocking fees. We reserve the right to modify pickup hours and procedures as necessary.

7. Product replacements

• We will not accept any request for the return, exchange or refund of Products upon delivery of Products. Replacement of Products may be arranged only for situations listed in Clause 7.5 below.
• Images of Products on the E-shop may not correspond entirely to Product description and are for general reference only.  The Customer shall not be entitled to return a Product or request a refund on the basis that it does not correspond exactly to its online image.
• The E-shop and all information in relation to the Products in the E-shop are provide “as is” and for general reference only.  We provide no warranties, representations or undertakings in relation to their accuracy or availability.  To the fullest extent permitted by applicable law, we shall assume no obligation or liability for any advice or information provided with Products displayed on the E-shop and shall not be responsible for any inaccuracy or misstatement of any such information.
• We shall use reasonable endeavours to ensure that orders are correctly fulfilled.
• We only accept the following cases for product replacements:

1. 1. Damaged Product(s)
   2. Missing item(s)
   3. Wrong Product(s) delivered
   4. Product Quality Issue(s)
      
      If you find the above case(s) upon receiving your order, please contact us via  dispensary@gleneagles.hk within 48 hours after your order is received.

• Product(s) to be replaced (except damaged product(s) or product(s) with quality issue(s)), have to retain intact packaging.  All returned Products will be thoroughly inspected and replacement will be arranged only if requirements are met.
• The liability of Gleneagles Pharmacy for any Product delivered in the cases set out in Clause 7.5 above is limited to replacement of the same Product as specified above. In the event that a replacement for the same product cannot be provided (e.g., due to product shortage or discontinuation), we may facilitate an exchange for an alternative product from our offerings. Should the alternative product have a higher value, the customer will be responsible for paying the difference.All other remedies are expressly excluded.
• In the case of dispute, we reserve the right of final decision.

8. Miscellaneous

• Title: Title to the Products shall remain vested in us until we receive full payment of the price, and risk shall pass to the Customer upon delivery.

• Force majeure: We shall not be liable for any delay or failure to perform caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes beyond our control.
• Variation of Terms and Conditions: We have the absolute discretion to make changes to any of these Terms and Conditions from time to time without prior notice to you.  A copy of the latest version of these Terms and Conditions is available on the E-shop. You are reminded to review the Terms and Conditions prior to submitting any order or registering a user account.  Once an order is placed or a user account is registered, you are deemed to have accepted the Terms and Conditions prevalent at the time.

• Severance: If any provision of these Terms and Conditions shall be construed to be illegal or invalid, they shall be removed from these terms and it shall not affect the legality, validity and enforceability of the other provisions of these Terms and Conditions.

• Entire agreement: These Terms and Conditions set out the entire agreement relating to the supply of goods to you by us via the E-shop and they supersede all previous negotiations, representations and agreement between the parties.
• Prevailing language: Where these Terms and Conditions are available in Chinese, the English version is the governing version and shall prevail whenever there is a discrepancy between the two versions.

10. Applicable law

These Terms and Conditions shall be governed by the laws of the Hong Kong Special Administrative Region, the People’s Republic of China and the Customer and the Parties hereby agree to submit to the exclusive jurisdiction of the Hong Kong courts.

Personal Information Collection Statement ("PICS")

This PICS is issued pursuant to the PDPO in relation to the operation of our online retail pharmacy business:  (https://pharmahome.gleneagles.hk) (the “E-shop”) by Gleneagles Dispensary [later change to Gleneagles CarePlus Pharmacy/Gleneagles Community Pharmacy], a member of GHK Hospital Limited [later change to Parkway Medical Services (Hong Kong) Limited] (together referred to as “we” or “us”).

2. Definitions
   Under this PICS, unless the context otherwise requires, the following words and expressions shall have the following meanings:
   

   2.1.	“Database”	means the database of our customers’ Personal Data.

3.1 In order for you to become a Registered Customer and to enjoy our various products and services, it is necessary for you to provide us with certain essential Personal Data as indicated at the time of collection. We may also ask for other information which helps us to offer you tailored products and services that we think may be of interest to you. The types of Personal Data we may collect include your name, address, email, telephone number, date of birth, gender, age, shopping preferences.

3.2 We shall have the right to collect, hold, process and/or use, the Personal Data in the Database in each case for the purposes as set out in, and in accordance with, this PICS. If you are unable or unwilling to provide us with complete and correct Personal Data, we may not be able to provide or continue to provide our products and services to you.

 

4. Use of your Personal Data

You agree that the Personal Data you provide to us and all information relating to the use of the E-shop may be used and retained by us for:

4.1. processing your application as a Registered Customer;

4.2. providing you with our services;

4.3. the normal management, operation, and maintenance of the E-shop;

4.4. providing you with regular communications from us with details of our retail business and relevant benefits;

4.5. providing you with Products which you have requested;

4.6. processing your order for purchases via the E-shop, including verifying your payment details/status;

4.7. carrying out prize draws, games or competitions which you have entered;

4.8. carrying out data sorting and analysis to enable us to better understand your characteristics and buying behaviour and to provide other services better tailored to your needs, and to assist us in selecting Products that are likely to be of interest to you;

4.9. designing new or improving existing services provided by us, Our Representatives, Our Affiliates and/or Our Subsidiaries to you;

4.10. investigation of complaints, suspected suspicious transactions, and research for service improvement;

4.11. prevention or detection of crime;

4.12. disclosure as required by law; and

4.13. aggregated behavioural analysis.

5. With your consent or implied indication of no objection, we will use your Personal Data for direct marketing to you (whether by post, email, phone, SMS, or other media whether now known or available in the future) in relation to latest news, offers, promotions, services and rewards from:

5.1. us; and/or

5.2. third party merchants that we cooperate with to provide benefits to you in relation to: retail, beauty, healthcare and wellness, personal care, toiletries and medical, baby care, maternity care, ,

We may disclose and transfer (whether in Hong Kong or abroad) your Personal Data to our agents or contractors who are also under a duty of confidentiality to us of the same standard as we have to you, and who provide administrative, data processing, research and marketing, distribution, telecommunications, professional or other similar services to us.

7. Browsing information collected from you (Cookies)

7.1. We use cookies and similar technologies to collect data about you when you visit the the E-shop, mobile application(s) and our other related websites (collectively referred to as “Sites”). Cookies are files that store information on your computer hard drive or browser so as to enable us to recognise that you have visited our Sites before. We use cookies to give you the best possible experience on our Sites, by evaluating your use of our Sites and reviewing your browsing and shopping habits, personalizing your website experience, evaluating website activity on our Sites and generally making our Sites easier to use.

About using our Sites

10. When you choose to use access or download our Sites or allow connectivity via Wi-Fi connections to your device, we receive information about your location and mobile device, including a unique identifier for your personalised device, your GPS data or wireless networks data (WLAN). Location data is neither stored nor transmitted to third parties. If you agree with the localisation function and/or enable the notifications function on your device mobile, we can provide you with location-based services including advertising, search results and personalised content. We can use push email communications or notifications (such as recommended promotion and recommended products) to you based on your geo-location data services and/or immediately previous on-line activities if you have provided your consent to receive such communications and advertising.

Most mobile devices allow you to turn off location services and push notifications on your device. Should you wish to do so, please access your own device and vary the settings for notification on your device to reflect your own preference to be notified (or not) following the relevant instructions under your device.

Your rights in relation to your Personal Data

12. You have the right to:

12.1. check whether we hold any of your Personal Data;

12.2. access your Personal Data held by us;

12.3. require us to correct any Personal Data which is inaccurate;

12.4. ascertain our policies and practices (from time to time) in relation to Personal Data and the type of Personal Data held by us; 

12.5. opt out from receiving direct marketing materials from us at any time.

Miscellaneous

16. Nothing in this Privacy Policy shall limit your rights under the PDPO and any other relevant local laws.

17. If there is any inconsistency or conflict between the English and Chinese versions of this Privacy Policy, the English version shall prevail.

18. This Privacy Policy shall be governed by, and construed in accordance with, the laws of the Hong Kong Special Administrative Region.
